Terms & Conditions

Please read our policies carefully to ensure a clear understanding of your journey with Losarea Tours & Safaris.

When it comes to embarking on a safari adventure, both Losarea Tours & Safaris and their customers need to have a clear understanding of the terms and conditions involved. These terms and conditions outline the responsibilities and expectations of both parties, ensuring a smooth and enjoyable experience for everyone involved.

1. WHO WE ARE

All tours and adventures are operated by Losarea Tours & Safaris, a company Losarea proprietor registered and incorporated in the United Republic of Tanzania.

2. WHEN THE TERMS AND CONDITIONS APPLY

These Terms and Conditions shall govern the relationship between Client and Losarea Tours & Safaris (Travel Agent: Losarea Tours & Safaris; further- “the Company”) and apply in the following situations:

  • When you book a trip directly with us;
  • When you book a trip through our partners acting as our sales representatives;
  • When booking a trip with us directly or through one of our partners, which includes various travel agencies and marketplaces, both sides automatically agree to be bound by these Terms and Conditions.

Please note that these Terms and Conditions stipulate the rights and responsibilities that you have while booking and taking part in our tours in Tanzania. (Our tours and safaris taking place in Kenya and Uganda will be run as per our partners’ terms and Conditions, which will be made available to you upon request and confirming your African Safari with us.)

3. OUR WARRANTIES AND REPRESENTATIONS

We warrant and represent that:

  • We have all the necessary licenses and permits to organize and run wildlife safaris and Kilimanjaro climbing expeditions in the United Republic of Tanzania;
  • We possess relevant expertise and experience and have taken care of the travel arrangements for hundreds of visitors of Tanzania and Kenya so far;
  • All our Kilimanjaro guides, wildlife safari driver-guides, and consultants have professional training in their respective fields;
  • All information that we use in marketing and advertising is true and correct. We do not exaggerate or misrepresent anything in the description of our products;
  • We are a tour operator, not a travel agency. No part of our adventures is handled by third parties except for Kenya, Uganda and accommodation in certain hotels, which do not belong to our company, and domestic and international air travel services;
  • We also warrant and represent that your trip with Losarea Tours & Safaris will positively impact the developing communities of Tanzania.

4. TREATMENT OF YOUR PERSONAL INFORMATION

  • We shall require certain personal information to take care of your expedition arrangements. Such information includes your full name, age, nationality, passport information, diet, and medical particulars.
  • Parts of this information will be made available to the administration of the Tanzania wildlife areas for the processing of entry permits and to the accommodation providers to make your stay comfortable.

Behind every safari or Kilimanjaro expedition is a coordinated effort by a large, passionate team. Our managers invest hours in carefully planning each itinerary. Our reservation agents, all based in Tanzania, work diligently with hotels and lodges to secure your stay. Kilimanjaro expedition coordinators check and prepare your climbing gear, while our supply teams partner with local farms to source fresh, sustainable ingredients. Every tour is the result of meticulous collaboration and local expertise.

The livelihoods of numerous families depend on the tourism we help facilitate, and we take that responsibility seriously.

6. CORRESPONDENCE AND COMMUNICATIONS

To avoid travel scams, ensure all the communications are from the following Channels:

  • Email: all emails must be from our domain, rarely losareatours@gmail.com. Our Current tour Consultants are Anitha and Ezra.
  • Phone and WhatsApp: Must be a Tanzania Phone number.
  • Other means: Online chat via our website.

7. PAYMENT PROCESS AND BOOKING

The booking process begins with your email or phone call to our offices. A personal travel consultant will be designated. Once details are agreed, an invoice will be issued. Your adventure will be deemed confirmed once a deposit payment reaches our account.

Deposit Rates:

  • 10% - Camping Safari
  • 20% - Budget Lodge Safari
  • 30% - Mid-range Safari
  • 50% - Luxury Safari

Full payment for your tour must be made 7 days before the scheduled commencement date unless otherwise agreed. All travel packages should be fully prepaid. A 3.5% surcharge shall apply to all credit card payments.

8. BOOKING BY THIRD PARTIES

If you are a tour leader or travel agent making a booking on behalf of others, you will be responsible for informing other participants of these Terms and Conditions, completing payments timely, and providing accurate information. If you cannot accept responsibility, every group member should book individually.

9. PRICES

Once confirmed, the price will not change unless the government of Tanzania increases fees or taxes. In such a case, you may either cancel for a refund (per policy) or pay the difference.

Major Quotation Errors: In the rare event of a significant pricing error, we reserve the right to correct or withdraw the offer.

10. TOUR ELEMENT MODIFICATIONS

We reserve the right to make reasonable changes to accommodate logistical needs. In rare cases of force majeure (weather, strikes), any extra costs incurred will be the client's responsibility. Minor modifications (e.g., changing sequence of parks or equivalent lodges) may be made without prior consent if necessary.

11. PAYMENT AND INVOICES

All payments must be made to official company accounts registered in Tanzania (Name: "Losarea Company Limited"). We do not operate offshore accounts. Payments can be made in USD, Euros, GBP, or TZS.

12. CHANGES TO THE ITINERARY

  • By Client: Free if no extra costs involved. If you discontinue a tour, no refund for unused services.
  • By Company: We may change itinerary due to weather/accessibility.
  • By Third Parties: We are not liable for third-party delays or disruptions.

13. CHANGES TO TRAVEL DATES

Must be informed no later than 60 days before the start date. New dates must be within one year. Extra costs (e.g., flight rescheduling, higher seasonal rates) must be covered by you.

14. CANCELLATIONS

I) Standard Cancellation Policy

  • $100 USD deposit is non-refundable (transferable to new dates).
  • 10% fee if cancelled >60 days before start.
  • 15% fee if cancelled 40-58 days before start.
  • 30% fee if cancelled 20-39 days before start.
  • 40% fee if cancelled 10-19 days before start.
  • 80% fee if cancelled 5-9 days before start.
  • No refund if cancelled 0-4 days before start.

II) Luxury / High-End Safari Cancellation

  • $100 USD non-refundable deposit.
  • 10% fee >90 days before.
  • 30% fee 60-89 days before.
  • 60% fee 30-59 days before.
  • 80% fee 8-29 days before.
  • No refund 0-7 days before.

Cancellation by Us: In the unlikely event we cancel, a 100% refund applies.

15. TRAVEL DOCUMENTS & VISAS

Passport must be valid for 6 months beyond entry. Visas are your responsibility. We are not liable if entry is denied.

16. ACCOMMODATIONS

Prices based on double/twin sharing. Single supplements apply for solo travelers wanting their own room/tent. Note: Single tents not possible on Marangu route.

Kilimanjaro Trekking Policy:

  • Early Descent: No refunds for unused days. Accommodation/transport costs after early descent are your responsibility.
  • Last Minute Cancellation: Within 24 hours = 50% fee.

17. MEDICAL INFORMATION AND FITNESS

You must determine your fitness level. We may require a medical form. If you have pre-existing conditions, a doctor's sign-off may be needed. We reserve the right to decline participation for safety reasons.

18. TRAVEL INSURANCE

Comprehensive travel insurance is mandatory. For Kilimanjaro, it must cover high-altitude trekking (up to 6,000m) and helicopter evacuation.

19. VACCINATIONS

Seek professional medical advice regarding vaccinations for Tanzania (e.g., Yellow Fever).

20. AUTHORITY OF OUR GUIDES

Our guides have full authority. We reserve the right to terminate participation if behavior causes distress, danger, or violates laws. On Kilimanjaro, the chief guide's decision on safety and descent is final.

21. A PROBLEM ARISING DURING THE TRIP

Report any issues immediately to your guide or consultant so we can resolve them on the spot. Issues reported only after the trip may not be considered for compensation.

22. RISKS OF ADVENTURE TRAVEL

You acknowledge the risks inherent in adventure travel (wildlife, high altitude, remote areas) and release us from liability for loss, injury, or death resulting from these inherent risks.

23. PROPERTY DAMAGE

You will be charged for willful destruction or damage to our property or hotel property.

24. LIABILITY TO THIRD PARTIES

We act as an agent. We are not liable for the performance of airlines or independent hotels, though we select partners carefully.

25. VALUABLES AND LUGGAGE

We are not responsible for lost/damaged luggage by airlines. We will assist with rental gear if luggage is delayed. You are responsible for your personal valuables during the tour.

26. SPENDING MONEY

Bring sufficient funds for tips, souvenirs, and drinks not included in the itinerary.

27. EQUIPMENT

Personal gear for Kilimanjaro is your responsibility (rentals available).

29. IMAGES AND MARKETING

We may use photos/videos taken during tours for marketing without royalty payments. Inform us if you do not wish to be photographed.

30. FORCE MAJEURE

We are not liable for events beyond our control (natural disasters, war, strikes, etc.).

31. SAFEGUARDING YOUR BOOKING

  • Advance Supplier Payments: We pay lodges/parks in advance.
  • Separate Funds: Profit margins held separately until trip completion.
  • Mandatory Insurance: Protects you from unforeseen cancellations.

32. WHY WE ARE THE BEST

We offer flexibility and case-by-case consideration for cancellations due to exceptional circumstances (illness, death, etc.), aiming for refunds where possible.

33. ADDITIONAL EXCURSIONS

Optional activities provided by third parties are not part of our official contract, and we accept no liability for them.

34. GOVERNING LAW

The laws of the United Republic of Tanzania shall apply in case of any disputes.
